In order to fulfill Ukraine’s international obligations and transpose the EU Directives of EIA, the Verkhovna Rada of Ukraine has approved the Law of Ukraine “On Environmental Impact Assessment” No. 2059-VIII (Law №2059) which became effective since May 23, 2017 and establishes the legal and organizational base for environmental impact assessment aimed to prevent environmental damage, environmental safety ensuring, environmental protection, rational use and recreation of natural resources in the decision-making process on economic activities that may have a significant impact on the environment, taking into account state, social and private interests.
In European practice, EIA of high-quality is an effective tool for business planning and an important element of the sustainable development ensuring for the territories within which the activities are carried out. Findind a balance between preserving the environment, business interests and providing the state with strategically important resources – is the common task of the state and the public sector.
The state and business are interested in a clear and understandable EIA procedure, which, among other things, helps to identify and assess the environmental and related economic and social risks timely and avoid the unnecessary waste of time and resources during the planned activities accomplishment. This procedure will also help in investments attraction, and will simplify work with international financial institutions (EBRD, World Bank, etc.).
The EIA is a procedure conducted by the competent authorities, which has clearly defined stages, rights and responsibilities of its subjects, which provides:
• Preparation of an environmental impact assessment report by the business entity;
• Conducting a public discussion;
• Analysis of the environmental impact assessment report information, any additional information provided by the business entity, as well as information received by the community during the public discussion, and the transboundary impact assessment procedure accomplishment, and other information by the competent authorities;
• Provision of a reasonable resolution on the environmental impact assessment, taking into consideration the analysis’ results by the competent authorities;
• Taking into consideration the resolution on the environmental impact assessment in the decision-making process on planned activity conduction (Article 2 of the Law “On EIA”).
Conscientious realization of this procedure in the decision-making process of economic activities conduction that may have a significant impact on the environment, has an effect of achieving the expected goal – prevention of environmental damage, environmental safety ensuring, environmental protection, rational use and recreation of natural resources.
The environmental impact assessment is intended to identify the nature of impact’s intensity and danger level during realization of any type of planned economic activity on the environment and public health.
The Ukrainian State Geological Research Institute (USGRI) has a positive experience in the environmental impact assessment (EIA) development and conduction and in providing support during the procedure.
